According to Virginia Statute 18.2-10, there are clearly outlined punishments for each class of felony in the state. Class 1 felonies are the most serious and see the harshest punishments while class 6 felonies are one step above a misdemeanor. Charges for each type of felony offense are:

  • Class 1 felony – If the individual is over the age of 18, the conviction will either be sentenced to death or life in prison. The maximum potential fine is $100,000;
  • Class 2 felony – The convicted will face a prison term between 20 years and life. The maximum potential fine is $100,000.
  • Class 3 felony – The convicted will face a prison term between 5 years and 20 years. The maximum potential fine is $100,000.
  • Class 4 felony – The convicted will face a prison term between 2 years and 10 years. The maximum potential fine is $100,000.
  • Class 5 felony – The convicted will face a prison term between 1 year and 10 years. The maximum potential fine is $2,500.
  • Class 6 felony – The convicted will face a prison term between 1 year and 5 years. The maximum potential fine is $2,500.

What are the Punishments for Each Class of Misdemeanor in Virginia?

Even though a person may not be punished with jail time, being convicted of a misdemeanor can still mean hefty fines. According to Virginia Statute 18.2-11, the following penalties are associated with each class of misdemeanor:

  • Class 1 misdemeanor – The convicted may serve up to 12 months in jail. The maximum potential fine is $2,500.
  • Class 2 misdemeanor – The convicted may serve up to six months in jail. The maximum potential fine is $1,000.
  • Class 3 misdemeanor – The maximum potential fine is $500.
  • Class 4 misdemeanor – The maximum potential fine is $250.
